WHAT IS THIS PARTICULAR SESSION ABOUT?

Harassment in the workplace is complex.

What’s that? Tell you something you don’t already know?

Well, I’ll tell you this: it’s even more complex than you think!

For instance, did you know that most investigations are undertaken through the traditional labor or employment lens, but that under OHS legislation - the legislation that actually mandates the investigation - harassment is actually defined and approached differently? And you better believe that difference has big implications for how complaints must be handled and investigated.

This session cuts through the confusion by exploring harassment through the OHS lens — a perspective that often gets overlooked but is crucial for compliance and effective response. You’ll gain a clear understanding of what harassment truly means under OHS law and why that matters when it comes to mandated investigations.

We’ll unpack the five (yes - five - did you know that!?) different legal definitions and types of harassment, and delve into the important interplay between them that can complicate cases and lead to costly missteps. You’ll also learn key considerations for managing harassment complaints and investigations, including when to bring in outside experts to ensure thoroughness and fairness without overstepping your role.

And beyond legal compliance, we’ll discuss how mishandled harassment claims can damage workplace culture, morale, and reputation — and share practical strategies to help build a respectful, safe environment where harassment has no foothold.

Friday, October 20, 2023, 8:00 AM - 10:00 AM (Mountain Time), following which this session will be retired.

WHAT IS THE WEBINAR FORMAT?

  • Sessions take place via the Google “Meet” platform;

  • Sessions can be purchased independently, or as a package;

  • You do not need a Google account to attend the sessions, and can attend via telephone;

  • Within 24 hours of registration, a link (and phone number) to access the session(s), along with instructions on how to sign in, will be forwarded to the email address you provided;

  • You will receive email reminders 24 hours and 10 minutes before each particular session that you have registered for;

  • Each session is 2 hours long. The first hour is devoted to sharing the substantive material of the relevant topic. Should you choose to remain after the first hour, the second is for your questions and discussion;

  • Although all attendees will have microphone rights, use of microphones will be limited to the second hour of each session(s). Use of the interactive chat box for questions to the facilitator and discussion with other attendees, is encouraged throughout both hours; and

  • Given our practice, many of the examples used in the series will come from Alberta, but the underlying principles and concepts that are discussed are applicable on a national scale.

ABOUT THE FACILITATOR:

As a former OH&S Crown Prosecutor, Christopher Spasoff is one of only a handful of lawyers with experience on both sides of the OH&S regulatory regime. 

Often sought out for his practical, easy-to-understand advice and common sense approach to problem solving, Christopher left the Crown in May 2014 to establish F2 Legal Counsel, the first and only law firm in Alberta exclusively dedicated to the practice of occupational health and safety law. As an advisor to both employers and workers on a variety of OH&S issues, Christopher is passionate about sharing his knowledge and experience whenever possible.
